• Requirements
  • 1. The full name, address and nationality of the applicant
    2. The full name, address and nationality of the inventor
    3. A specification containing a detailed description of the invention, a set of claims, an abstract and drawings if necessary
    4. An executed Power of Attorney, signed by the applicant or the representative of the applicant company, which may be a General Power of Attorney on file with the Korean Intellectual Property Office
    5. A Priority Certificate of the home application, including the filing date, filing number and the country where filed, when claiming a convention priority
         
  • Provision for Late Filing
  • The Power document may be late-filed with the payment of a late fee. The due date for late filing, which is determined shortly after filing the application, is one month from the issuance of a Notice to Supplement Power. This due date, however, may be extended. When claiming priority, the Priority Certificate(s) may be submitted within sixteen months from the earliest filing date.
         
  • Request for Examination
  • A patent application shall be examined only upon the filing of a Request for Examination. The application and Request may be filed simultaneously. In the absence of any timely request for examination, the application is deemed to be withdrawn. Therefore, an automatic withdrawal will occur if no request for examination is made within five years from the effective filing date, which is normally the Korean filing date or the international filing date of a PCT application. This term cannot be extended.
         
  • PCT International Application
  • When entering the Korean national phase of a PCT application, it is best to forward a copy of the cover page of the WIPO publication of the corresponding PCT application. Once the PCT international publication number is known, all of the necessary application information can be obtained locally. This information includes the relevant data of the above Requirements items (1), (2), (3) and (5). The term for entering into the national phase in Korea is 31 months from the international filing date (or priority date, if any) regardless of whether the International Preliminary Examination is requested or not.
