| A Divisional application is available after a decision to grant a patent |

Previously, in Korea a divisional application could not be filed after a decision to grant a patent was issued. However, under the revised patent act dated January 28, 2015, an applicant may file one or more divisional applications in order to seek protection for those inventions contained in the initial application but not covered by the allowed claims. This must be done before paying the first through third annuities within 3 months from the date of receipt of a decision to grant a patent by examiner, or trial decisions to cancel a final rejection on or after July 29, 2015
