The Revised UCPA Expands Protection for Trade Dress

The Unfair Competition Prevention and Trade Secret Protection Act (UCPA) was revised on April 17, 2018, and implemented on July 18, 2018 to expand protection for trade dress. The revised UCPA states


1) that the act of mimicking the visual appearance of a business place well known to general consumers is an act of unfair competition,


2) and that if anyone obtains anothers’ technical or business idea in the course of a transaction, consultation or business negotiation, bidding or via other similar routes and illegally uses such idea or gives it to a third party for economic purposes, such an act is considered an act of unfair competition.
